LOUISIANA COURT DISMISSES PORTION OF SUIT AGAINST ATMOS ENERGY'S TRANS LOUISIANA GAS DIVISION

DALLAS, Jan. 21 /PRNewswire/ -- Atmos Energy Corporation (NYSE: ATO) announced today that the Louisiana Supreme Court has reversed the rulings of two lower courts on jurisdiction of a lawsuit brought against the company's Trans Louisiana Gas Company division.
The Supreme Court ruled on Tuesday that all issues relating to overcharges in the suit brought by the Lafayette Daily Advertiser and others are within the exclusive jurisdiction of the Louisiana Public Service Commission. The suit brought in March 1991 against Trans Louisiana Gas Company (Transla) and others, alleges overcharges for natural gas to approximately 60,000 customers in Transla's service area. The lawsuit claimed that Transla and its primary supplier, Louisiana Intrastate Gas Company (LIG), conspired to manipulate the cost of gas charged by LIG to Transla, which resulted in overcharges to customers.
The company and other defendants have denied the allegations and have asserted that the issues in the lawsuit relate solely to rates, and should be examined exclusively by the Louisiana Public Service Commission.
The Supreme Court's ruling dismisses all issues in the lawsuit relating to cost of gas and alleged overcharges, and remands claims, if any, not relating to overcharges to state district court in Lafayette, La. However, all state court proceedings are deferred until the conclusion of a proceeding already under way at the Public Service Commission dealing with the cost of gas practices of Transla and LIG.
