LIFSCHULTZ APPEAL DENIED

 PALO ALTO, Calif., July 8 /PRNewswire/ -- In a decision issued today, a federal appeals court has affirmed the dismissal of a lawsuit filed by David K. Lifschultz that raised anti-trust allegations against Consolidated Freightways (NYSE: CNF) and two other national trucking companies.
 In denying Lifschultz's appeal, the three-member U.S. Fourth Circuit Court of Appeals said unanimously that the decision by Federal District Court Judge Henry M. Herlong Jr., who dismissed the case last year, was both thorough and well-reasoned.
 Herlong had granted summary judgment to CF and the other trucking companies, saying that Lifschultz had not proved his case and that the testimony of his principal expert witness "read like a cheap novel."
 Consolidated Freightways Inc. is a $4.1-billion diversified transportation company with businesses in long-haul and regional trucking, air freight, intermodal services, customs brokerage and logistics management.
