 LAND O'LAKES COMMENDS STATE SUPPORT FOR MARKETING ORDER LAWSUIT
 ARDEN HILLS, Minn., Aug. 21 /PRNewswire/ -- The state of Minnesota has taken positive action in support of a lawsuit against USDA's administration of federal milk marketing orders, according to an official of Land O'Lakes, Inc. Jack Gherty, CEO of the dairy cooperative, commended state officials for releasing funds in support of the suit.
 State Ag Commissioner Elton Redalen presented a check for $50,000 to the Minnesota Milk Producers Association on Aug. 19. The independent dairy organization's lawsuit charges that Class I differentials, as administered by USDA, are illegal.
 Currently, Minnesota dairy farmers get paid a differential of $1.20 per hundred pounds of milk used for bottling fluid milk. In south Florida, the differential is $4.18. If the suit succeeds, USDA will have to adopt new differentials that don't discriminate against Midwest dairy farmers.
 "This is an issue of fairness to milk producers in the upper Midwest," Gherty commented. "Land O'Lakes commends the state government for putting resources into the legal challenge."
 Besides supporting the Minnesota Milk Producers lawsuit, Land O'Lakes participated in a Midwest coalition that testified at a series of national hearings on Class I differentials in 1990. USDA's preliminary response to the hearings was to propose no changes in the differentials.
 Land O'Lakes also supports legislation to mandate adoption of the Midwest Coalition's plan.
