LABATT FILES SUIT AGAINST MOLSON, MILLER, CHARGING VIOLATION OF TRADEMARK

TORONTO, Nov. 30 /PRNewswire/ -- John Labatt Limited issued the following:
In a lawsuit filed yesterday in U.S. Federal Court in Detroit, John Labatt Limited charged Miller Brewing and Molson Breweries with violating federal trademark and other laws by marketing so-called ice beer products in the United States.
"We introduced ICE BEER in the U.S. in October," said George Taylor, president and chief executive officer of John Labatt Limited. "We are confident it will have the same stunning success in America as it has had in Canada. Indeed, the Canadian launch of Labatt's ICE BEER was the most successful new beer product launch in Canadian history," Taylor noted.
"So we're not surprised our competitors are trying to get in on the action. But we will not tolerate their efforts to deceive consumers. ICE BEER has given Labatt's a major competitive advantage in the international beer industry, and we intend to do everything we can to ensure that we retain that edge.
"Labatt's suit is an effort to vigorously protect our rights," said Taylor. "Competitors will not be permitted without challenge to misappropriate Labatt's rights in this area where Labatt has demonstrated clear leadership and innovation."
The suit charges Molson and Miller (which owns 100 percent of Molson Breweries USA) with unfair trade practices, tortious interference and injurious falsehood in the promotion of their so-called ice beer products in the United States. Copies of the lawsuit are available on request.
In Canada, proceedings are underway which were initiated by Labatt against Molson Breweries of Canada for Molson's misuse and misappropriation of Labatt trademark rights related to Labatt ICE, ICE BEER and ICE BREWED.
John Labatt Limited's brewing investments include Labatt Breweries of Canada, Labatt's USA and Labatt Breweries of Europe.
Labatt Brewing Company has a 44 percent market share of the Canadian market and operates nine breweries across Canada. Labatt's USA operates in the high-quality segment of the United States beer market as both a brewer through Latrobe Brewing company, brewer of Rolling Rock and as an importer of beer from Canada, Italy and elsewhere. Labatt Breweries of Europe consists of Labatt Brewing UK in England and Birra Moretti in Italy.
In addition to brewing, Labatt businesses include broadcasting through TSN and RDS, Canada's all-sports television networks and the back-to-back World Series champion, Toronto Blue Jays, the John Labatt Entertainment Group of companies which include Supercorp, BCL Entertainment, International Talent Group and Skyvision Entertainment.
