Kintera Achieves Complete Victory In Trademark Infringement Lawsuit Against Convio.

Convio Agrees to Immediately Cease and Refrain From

Infringing On Kintera's "Friends Asking Friends" Trademark

Kintera Inc., the leading provider of Internet marketing services to nonprofits, announced today that it has achieved complete victory in its trademark infringement lawsuit against Convio Inc. for infringing Kintera's "Friends Asking Friends(TM)" trademark.

Convio has agreed to immediately cease and refrain from all use of the Convio "Friend2Friend" name. In addition, Convio has agreed to immediately stop all use of any translations or phonetic equivalents of any mark confusingly similar to Kintera's Friends Asking Friends trademark. In exchange, Kintera has agreed to dismiss its lawsuit against Convio.

"Kintera and nonprofit organizations will not tolerate the misappropriation of any name or other intellectual property," stated Harry Gruber, M.D., CEO of Kintera.

In December 2001, Kintera filed a lawsuit for trademark infringement against Convio, an Austin, Texas-based company, in the United States District Court of the Southern District of California. The complaint alleged that Convio deliberately and willfully used the Friend2Friend name in connection with the advertising, marketing, distribution and sales of Convio's services in an attempt to trade on the goodwill, reputation and selling power established by Kintera under its Friends Asking Friends trademark. Kintera asked the court for a preliminary and permanent injunction that would prevent Convio from using the Friend2Friend name.
