Kazakhstan adopts new Criminal Code.

President of Kazakhstan Nursultan Nazarbayev signed July 3 the draft Criminal Code of the Republic of Kazakhstan.

The Code is aimed at modernizing the criminal law in order to strengthen the fight against crimes in modern conditions, increase the level of protection of citizens' rights and interests of the state, the press service of Akorda noted.

The most important novel of the draft Criminal Code is introduction of the two-tier system of criminal offenses, consisting of crime and criminal offenses.

Since the aim of the draft Criminal Code is humanization of criminal legislation, the Article 430 excludes some parts. The bill provides a wide range of mild forms of punishment for non-serious crimes that are primarily public works.

In addition, 45 articles have excluded confiscation of property as a form of additional punishment.

The draft Criminal Code included capital punishment on a number of new articles. The death penalty now is imposed on violation of the rules of warfare (Article 164), violation of international humanitarian law during the armed conflict (Article 165), and international terrorism (Article 253).

First Deputy Prosecutor General of Kazakhstan Johann Merkel said such measures are necessary for fulfilling Kazakhstan's international obligations, including Geneva Convention on protection of war victims.
