 KNOW YOUR RIGHTS AS A TAXPAYER ADVISES KPMG PEAT MARWICK
 NEW YORK, March 5 /PRNewswire/ -- No longer does the IRS have all


the advantages in dealing with taxpayers. Taxpayers have rights, too. And now that tax filing season is in full swing, KPMG Peat Marwick, the international accounting and consulting firm, would like to remind taxpayers of their rights when dealing with the IRS.
 IRS personnel are expected to deal with you in a professional, courteous manner and should:
 -- Provide you all the information and help that you need to comply with tax laws;
 -- Ensure personal and financial confidentiality;
 -- Provide clear explanations in any IRS notice or mail inquiries, and supply additional information if requested;
 -- Collect taxes fairly. For example, the IRS cannot sell your home just to collect taxes without the permission of the local district director;
 -- Give you time to contest an erroneous levy. For example, bank accounts cannot be seized or 21 days and other property cannot be seized for 30 days. But the IRS can freeze these assets during the waiting period;
 In interacting with the IRS, the taxpayer has specific rights, too. Among them are:
 -- The taxpayer may consult and/or be represented by a tax adviser, attorney, or other professional; representation must be accompanied by a properly executed power of attorney;
 -- The taxpayer may audio record an IRS interview if 10 days' notice is give; likewise, the IRS may record a meeting if you are informed 10 days in advance;
 -- If the taxpayer chooses to accompany its representative, IRS interviews can be suspended at any time to allow the taxpayer consultation with their tax professional;
 -- Taxpayer meetings with the IRS should be at a time and place that is mutually convenient;
 -- IRS mail notices can be contested;
 -- The taxpayer may appeal notices and findings of the IRS examiner and contest penalties;
 -- The taxpayer may contact the Problem Resolution Office (PRO) when normal procedures don't work. Where the taxpayer is suffering or is about to suffer significant hardship, a Form 911 should be filed.
 -- If the taxpayer cannot pay the liability in full, an installment agreement should be requested.
