KENDALL HOMEOWNERS TO FILE LAWSUIT AGAINST LENNAR HOMES,
CLAIMING NEGLIGENCE AND CITING DAMAGES FROM HURRICANE ANDREW
MIAMI, Aug. 30 /PRNewswire/ -- A group of Kendall homeowners whose community was devastated by Hurricane Andrew plan to file a lawsuit tomorrow against the builder of the community, Lennar Homes, Inc., claiming that Lennar was negligent when it built their homes in the late 1980s.
"We already sued Lennar once, because the homeowners had been sold a defective product," said Louis Robles, an attorney with the Miami law firm of Robles & Gonzalez who represents the homeowners of Hampshire Homes, a planned community located in West Kendall. "We were in the process of conducting further tests on the homes, but Mother Nature came along and tested them for us.
"Needless to say, Lennar failed the test."
The homeowners originally filed a lawsuit against Lennar Homes in May 1991, citing the use of improper materials such as untreated wood and non-galvanized steel bolts, screws and nails in the construction of their homes. Nearly all of the homes in the community suffered substantial damages as a result of the hurricane, including lost roofs, collapsed walls and flooding.
"Even before Hurricane Andrew hit last week, the roofs, porches and windows in the houses were falling apart due to a combination of rotting wood and rust from the non-galvanized steel," he said.
"There is a pattern that we have seen throughout much of South Dade, where two neighboring communities built by different developers suffered dramatically different damages as a result of the storm. We suspect that Lennar is just one of many builders who didn't follow the proper procedures in the construction of their developments."
