JEFFERSON-PILOT ASKS APPEALS COURT TO VACATE LOWER COURT RULING

JEFFERSON-PILOT ASKS APPEALS COURT TO VACATE LOWER COURT RULING
GREENSBORO, N.C., Oct. 14 /PRNewswire/ -- Jefferson-Pilot Corporation (NYSE: JP) today reported that it has filed a petition asking the U.S. Court of Appeals for the Fourth Circuit to vacate the partial summary judgment granted last April by the U.S. District Court for the Middle District of North Carolina in Louise Price Parsons' litigation against the company.
Jefferson-Pilot based its petition on the order entered by the appeals court on Sept. 30, which dismissed the appeal of the Middle District ruling as moot. The company had successfully urged the appeals court to make this ruling, arguing that the appeal had become moot because of the ratification by Jefferson-Pilot's shareholders at the company's 1992 annual meeting of an amendment to its stock option plan and stock grants made under that amendment.
The petition filed today asks the appeals court to take the additional step of vacating the Middle District partial summary judgment, a step which Jefferson-Pilot believes is mandated by Supreme Court and Fourth Circuit case law once an appeal has been dismissed as moot.
