India : NCDRC asked IOC & LPG Dealer to pay Rs.2 lakh compensation.

The death of a couple due to explosion of an LPG gas cylinder has cost the state-owned Indian Oil Corporation (IOC) and a cooking gas dealer Rs.2 lakh.

In a verdict, the National Consumer Disputes Redressal Commission (NCDRC) has directed the IOC and the Mysore-based dealer of liquefied petroleum gas (LPG), Shiva Gas Service, to compensate the relatives of the victims with the aforesaid amount.

Delivering an order in last week, the Presiding Member of NCDRC - K.S. Chaudhari and Member B.C. Gupta have asked the IOC and the LPG dealer to pay a compensation of Rs.2 lakh to the family of B.K. Thimmegowda, who died after an LPG gas cylinder exploded.

The commission has issued its verdict while hearing an appeal made by the United India Insurance Company Limited, Mysore, Karnataka, wanting to amend the order given by the Karnataka State Consumer Disputes Redressal Commission that asked the insurer and the LPG dealer along with the IOC to make damage payments.

The Karnataka commission had issued its order hearing the appeal of the Mysore resident Gowramma. In her plea, she had informed the commission that her father late B.K. Thimmegowda received an LPG gas connection for domestic use from Shiva Gas Service on 27th November, 1999.

Just a few days later, the LPG cylinder exploded. The explosion on 7th December, 1999, caused serious injuries to her parents and damaged property as well, according to her. On 10th December, 1999, the couple succumbed to their injuries.

In her complaint, Gowramma had alleged that there was deficiency in service, and asked for a compensation for the death of her parents and also for the damages caused to her moveable and immoveable properties.

Permitting the revision petition of the insurance firm, the commission has stated that "It is not obligatory on the part of the insurance company to make the payment to the complainants, as the said cylinder was not in the process of being installed under the terms and condition of the policy."
