India : MADRAS HIGH COURT allows Tangedco to secure PPA deal for Solar Power.

The Madras High Court has sanctioned the Tamil Nadu Generation and Distribution Corporation (TANGEDCO) to secure a power purchase agreement (PPA) as per the procedure reached at an outer capacity of 1,500 megawatt.

Altering its former interim order completely preventing TANGEDCO from securing these PPA, Justice T.S. Sivagnanam passed the order on a set of petitions placed by solar power production firms.

Raasi Green Earth Energy Private Limited located in Bengaluru and another alike firms have asked the court to direct the TANGEDCO to provide Noted for Record letter pursuant to their requests to start production and consequently implement a PPA for buying of power from them.

When the petitions came up for hearing, Advocate General A.L. Somayaji presented that TANGEDCO has taken a conclusion to fix a ceiling of 1,500 mw as the outer limit for securing PPA for 2015-16 and souht to alter the interim order, to which the petitioners consented.

There is total embargo on TANGEDCO from entering into PPA. This, in my view, would not be in the interest of both the petitioners and TANGEDCO, and ultimately in public interest it would be appropriate to modify the earlier order, said the judge.
