INTERMATIC SUES TAYMAC AND TAYMAC AGENT FOR TRADE LIBEL

INTERMATIC SUES TAYMAC AND TAYMAC AGENT FOR TRADE LIBEL
SPRING GROVE, Ill., Aug. 11/PRNewswire/ -- Intermatic Incorporated,

a 100-year-old, widely respected manufacturer of time switches, photo controls and other electrical products, has filed a complaint in the United States District Court in Indianapolis, Ind., against Taymac Corp. and Clifford Engineering and Sales Company of Indiana. Clifford
Engineering is a Taymac representative. In a complaint, Intermatic alleges that Taymac and Clifford Engineering conspired to make false statements to the trade regarding the status of Underwriters Laboratories' listing of Intermatic's ''Guardian'' weatherproof outlet box cover. UL has affirmed that Underwriters Laboratories' listing of these covers has never been withdrawn since their original listing in September 1991.
Intermatic charges that the false statements made by Clifford Engineering were induced by Taymac and were made intentionally with the knowledge of their falsity, or with reckless disregard for their falsity and were made to harm the commercial acceptance of the Intermatic product.
While no specific monetary damages have yet been claimed, Intermatic considers the action by the named defendants to be of a serious nature and will seek significant and appropriate monetary damages and other remedies.
In addition to the charge of trade libel, Intermatic has asked the court to declare invalid a patent held by Taymac related to the design of a weatherproof outlet cover. Intermatic vigorously denied any alleged infringement charged by Taymac in a separate action. Intermatic maintained that the Taymac Patent is invalid in that it fails to meet the conditions of patentability as specified in Title 35 of the United States Code.
In a discussion today, Intermatic officials said, ''We have reluctantly taken this action in court; however, the continued egregious behavior of Taymac in the market place and in apparently inducing its agents to widely disseminate knowingly false information could no longer be tolerated.
''It is Intermatic's intention to file additional complaints against any Taymac agents who have initiated the same or similar communication of false information regarding the UL listing status of Intermatic products.''
