INTERDIGITAL TECHNOLOGY ADDS THIRD PATENT TO ITS CDMA DECLARATORY JUDGMENT SUIT AGAINST QUALCOMM AND OKI

 KING OF PRUSSIA, Pa., Sept. 13 /PRNewswire/ -- InterDigital Technology Corporation (InterDigital Technology), a subsidiary of InterDigital Communications Corporation (AMEX: IDC), announced today it has filed a motion to add a third patent to the Code Division Multiple Access (CDMA) claims of its patent infringement declaratory judgment suit against Qualcomm Incorporated (NASDAQ-NMS: QCOM), OKI Electric Industry Company, Ltd. and OKI America, Incorporated in the U.S. District Court for the Eastern District of Pennsylvania. The patent, which was issued on June 2, 1992, is U.S. Patent 5,119,375, entitled Subscriber RF Telephone System for Providing Multiple Speech and/or Data Signals Simultaneously over Either a Single or a Plurality of RF Channels. The addition of this patent to InterDigital Technology's claim against Qualcomm is important because the invention covered by the patent is believed by InterDigital Technology to predate Qualcomm's CDMA work and to be basic to digital wireless telephony.
 This patent is already asserted in the lawsuit with respect to the Time Division Multiple Access (TDMA) subscriber units to be manufactured, used and sold by OKI Electric and OKI America and is being added for assertion against the CDMA equipment to be manufactured, used and sold by Qualcomm, OKI Electric and OKI America.
 For procedural reasons, a motion has been filed to add the patent to the complaint against Qualcomm, OKI America and OKI Electric.
 The lawsuit already includes InterDigital Technology's U.S. Patents 5,179,571 and 5,220,056. The suit asserts that CDMA handsets, to be manufactured by OKI under license from Qualcomm, will infringe the three InterDigital Technology patents. The lawsuit also asserts that CDMA equipment, to be manufactured by Qualcomm, will infringe the patents.
 In the lawsuit, InterDigital Technology seeks a preliminary injunction and a permanent injunction against Qualcomm, OKI Electric and OKI America manufacturing, using and selling products complying with IS-95, the narrowband CDMA standard.
