INTELLICALL SETTLES LAWSUIT WITH MESSAGEPHONE DALLAS, Feb. 13 /PRNewswire/ -- Intellicall, Inc. (NYSE: ICL), a
diversified telecommunications company, today announced that it has settled a lawsuit with MessagePhone, Inc. (MPI), a research and development, and intellectual property company. The suit, which was filed by Intellicall in Dallas County District Court in June 1990, involved claims relating to a patent license agreement under which MessagePhone provided Intellicall with a license to use technology relating to the provision of automatic voice messaging.
As part of the settlement, the suit was dismissed with prejudice. In addition, Intellicall and MessagePhone entered into an amended and restated patent license agreement covering MessagePhone's patented voice messaging technology. Under the new agreement, Intellicall will license MPI's automated voice messaging patents. Intellicall's voice messaging service allows a caller to leave a recorded message for later delivery by an automated system when the called party does not answer or when the line is busy. The service operates with Intellicall's patented Intelli(asterisk)Star system. The new agreement permits Intellicall to license MPI's patented technology on a non-exclusive basis for its markets worldwide. Intellicall's royalty obligation to MPI will be based upon the amount of revenue collected from use of voice messaging in the company's pay telephone and call processing technology. Intellicall will provide its dealers who enter into appropriate licenses for Intellicall technology and voice messaging with a software upgrade to provide the voice messaging capability. Intellicall and MessagePhone believe that their new agreements will facilitate use of voice messaging by the general public. "When you consider that 30 percent of all calls from public-access phones are not completed because of either a no answer of a busy signal, the potential consumer demand for this service is significant."
