ICN WINS AGAIN IN SUIT AGAINST KHAN

 NEW YORK, May 26 /PRNewswire/ -- The Second Circuit Court of Appeals in New York yesterday kept in place an order by Federal Judge John Sprizzo enjoining Rafi Kahn from seeking to change the management of ICN Pharmaceuticals, Inc. (NYSE: ICN) through any means.
 In issuing the injunction last week, Judge Sprizzo said that Khan, among other things, had willfully lied under oath during the four day injunction hearing; engaged in insider trading; violated his fiduciary responsibility to ICN; and failed to provide material information in filings with the SEC.
 ICN attorney Arnold I. Burns, a senior partner of Proskauer, Rose, Goetz & Mendolsohn and former Deputy Attorney General of the United States, said, "The action by the Court of Appeals is not surprising in light of Khan's conduct. Our legal system cannot countenance the undermining of a company by its underwriter who owes the company fiduciary duties and has fiduciary responsibilities."
