ICI AND MONSANTO SETTLE PATENT DISPUTE ON SAFENERS AND CONCLUDE REGULATORY AND PRODUCTION AGREEMENTS ON ACETOCHLOR

 WILMINGTON, Del., Nov. 17 ~PRNewswire~ -- ICI Americas, through its Agricultural Products business, and Monsanto Company (NYSE: MTC) have reached an agreement on a patent dispute related to chemical additives used as safeners with acetanilides herbicides, in particular, acetochlor, a pre-emergence herbicide for use on corn.
 Such safeners are necessary to protect the corn plant from herbicide damage. The dispute has ended with the signing in court of a Consent Decree between the companies acknowledging the validity of ICI's patents. The settlement arrangements will enable ICI and Monsanto to produce and market their own end-use safened acetochlor products in the United States once registration has been granted by the U.S. Environmental Protection Agency (EPA).
 As a consequence of this agreement, both companies will form a partnership to seek the earliest possible registration of acetochlor by the EPA. The two companies have also agreed to establish a partnership for the production of acetochlor at Monsanto's large scale acetanilide facility at Muscatine, Iowa, and from which both partners will have equal access to the acetochlor capacity.
 Both companies will, however, independently market acetochlor formulations containing their own proprietary safeners. ICI's trade name for the product in the United States will be "Surpass."
 Dan Thaden, an ICI Agricultural Products business director, said: "I am delighted that this dispute has been amicably settled. As a consequence of this co-operation the EPA will only require a single review for the registration of acetochlor. This clearly makes best use of regulatory resources at the agency. In addition, both companies will be able to enjoy, from the production sharing partnership, the economies of scale associated with the manufacture of acetochlor at a single large scale plant."
