HILTON INTERNATIONAL VS. HILTON HOTELS CORPORATION MOVES TO FEDERAL COURT

HILTON INTERNATIONAL VS. HILTON HOTELS CORPORATION
 MOVES TO FEDERAL COURT
NEW YORK, Dec. 12 /PRNewswire/ -- A lawsuit which seeks an injunction against use by Hilton Hotels Corporation of the name Conrad as the name of hotels outside the United States has been moved from the New York State Supreme Court to the United States District Court in Manhattan.
The complaint also seeks substantial damages resulting from the activities engaged in by Hilton Hotels Corporation and Conrad which "have been undertaken with the deliberate purpose of creating the false impression that Conrad Hotels are Hilton Hotels in order to trade off the goodwill of the Hilton name in territories where Hilton International has the exclusive rights to such name."
The case has been assigned to the Honorable John F. Keenan, who has scheduled a pre-trial conference for the beginning of February 1992.
The complaint alleges that Hilton Hotels Corporation has violated certain trademark agreements with Hilton International which give Hilton International the exclusive right to use the name Hilton as the name of hotels outside the United States.
The complaint also alleges that Hilton Hotels Corporation and its Conrad International subsidiary have adopted and promoted the name Conrad for hotels outside the United States "as a means of associating the hotels with Conrad Hilton, the original founder of both Hilton Hotels Corporation and Hilton International, and thereby benefiting from the reputation associated with him and the Hilton name." Further, it goes on to note that Eric Hilton, the president of Hilton Hotels Corporation subsidiary responsible for operating Conrad hotels, stated that the name Conrad was chosen because "if we said Conrad we would be saying Hilton without really being able to say it."
