 HERTZ AND AVIS SETTLE FALSE ADVERTISING SUIT
 NEW YORK, Jan. 17 /PRNewswire/ -- The Hertz Corporation, the world's


leading car rental company, and Avis, Inc., its No. 2 rival, reached a settlement in the third day of their false advertising trial in the U.S. District Court for the Southern District of New York in Manhattan.
 Following is the consent order:
 CONSENT ORDER IN HERTZ/AVIS FALSE ADVERTISING SUIT

 Jan. 15, 1992 4:30 p.m. -- Hon. William C. Conner, District Judge
 91 CIV. 5579 (WCC)
 The Hertz Corporation, (Plaintiff) vs. Avis, Inc. (Defendant)
 Upon consent of the parties, the above action and all claims and counterclaims asserted therein are hereby compromised and disposed of as follows:
 1. Avis shall not engage in any advertising of its receipt of the 1990 Alfred Award.
 2. Avis's counterclaims against Hertz for its print advertising and television advertising based on the results of its 11 year tracking survey and the results of certain polls and awards are dismissed with prejudice.
 3. Hertz shall, for future advertising claims based on the tracking survey:
 A. Ask the "best overall" question as the first substantive question following the screening questions and the instruction, and shall word said question as follows:
 "What is your opinion, if any, as to which one car rental company is the best overall for business or personal or vacation rental?"
 B. Include in any print advertising of such surveys a small print footnote stating that the claim is "based upon periodic tracking surveys of respondents from major metropolitan areas conducted for Hertz by an independent research organization."
 4. Nothing contained herein shall prevent Hertz from continuing its "best overall" claim, including the "numbers" commercial based upon its 11 year tracking survey.
 5. Both parties shall bear their own costs an attorneys fees.
 Both parties' claims for damages are dismissed with prejudice.
