 HAYES AND ZENITH DATA SYSTEMS SETTLE HAYES PATENT LITIGATION
 ATLANTA, Aug. 31 /PRNewswire/ -- Hayes Microcomputer Products, Inc. and Zenith Data Systems Corporation today announced an amicable out-of- court settlement of the patent infringement litigation between the two companies involving the Hayes '302 Escape Sequence Patent. They also announced that Zenith Data Systems intends to procure, for future sales, only modem products which use the patented Hayes escape sequence technology. Additionally, Zenith Data Systems will display the Hayes '302 Escape Sequence Patent Icon certification mark on all its Hayes- licensed modem products, signifying that they employ the Hayes patented Escape Sequence With Guard Time mechanism.
 "This is yet another example of a responsible manufacturer that understands the Hayes technology has significant advantages for reliable operation," said Hayes President Dennis C. Hayes. "Zenith Data Systems' intention to continue selling Hayes modems and other modems containing Hayes technology will help consumers avoid a situation where data alone causes the modem to escape into Command Mode."
 The Hayes escape sequence technology, first introduced in Hayes Smartmodem products in 1981 and issued as U.S. Patent Number 4,549,302 on Oct. 25, 1985, is now a data communications feature acknowledged as an industry standard for modems, ISDN and other data communications applications, with over 26 million units shipped to date worldwide.
 The litigation settlement includes a payment to Hayes for past infringement liability, resolves all claims filed by Hayes charging Zenith Data Systems with infringement of the Hayes '302 Escape Sequence Patent, and covers Zenith Data Systems Corporation and its related companies, including Heath Company and Veritechnology Electronics Corporation.
 Zenith Data Systems has sold Hayes modems for many years and continues to do so. Zenith Data Systems recently selected the patented Hayes Escape Sequence technology for use in modems sold as accessories to Zenith Data Systems' Z-NOTE notebook computers introduced in April. All of Zenith Data Systems' modem suppliers are now licensees of Hayes.
