HAYES AND CARDINAL SETTLE PATENT LITIGATION

 ATLANTA, Nov. 1 /PRNewswire/ -- Hayes Microcomputer Products, Inc. today announced that it has reached an amicable out-of-court settlement of the patent infringement litigation originally filed by Hayes against Cardinal Technologies, Inc. of Lancaster, Pa., in May 1991.
 The settlement includes a payment to Hayes for past liabilities and attorneys' fees and resolves all claims filed by Hayes charging Cardinal with infringement of the Hayes '302 Escape Sequence Patent.
 As part of the settlement, Cardinal consented to a judgment in Federal Court in Atlanta that the Modem with Improved Escape Sequence patent issued to Hayes in 1985 (Heatherington U.S. Patent No. 4,549,302) is valid, enforceable and has been infringed by the manufacture and sale of their products.

"This agreement further confirms the importance of this technology to the industry by which consumers are protected from situations where data alone causes the modem to escape into Command Mode."
 Hayes has now entered into approximately 40 licensing arrangements or other settlements involving the Hayes '302 Escape Sequence Patent. A number of those licenses and settlements have occurred as a result of successful trial and appellate court rulings granted to Hayes regarding the validity, enforceability and willful infringement of the patent.
 The Hayes escape sequence technology, first introduced in Hayes Smartmodem products in 1981, is now a data communications feature acknowledged as an industry standard for modems, ISDN and other data communications applications, with over 26 million units shipped to date worldwide.
