GEORGIA CROWN AND POLAND SPRING GRANTED TEMPORARY RESTRAINING ORDER
COLUMBUS, Ga., Sept. 3 /PRNewswire/ -- Georgia Crown Distributing Company and Poland Spring Corporation have been granted a temporary restraining order (TRO) that prohibits any restriction on the sale of their bottled water products in Georgia.
This action, granted by the Superior Court of Muscogee County, was taken in order for the companies to have additional time in providing technical information to the state which the state requested.
On Aug. 28, the Georgia Department of Agriculture issued a news release claiming that Poland Spring had failed to prove that their product met the state's definition of "spring water." Georgia Crown and Poland Spring had in fact submitted a variety of technical product data to the department, but additional information was requested.
"This issue is an administrative one of labeling, not of product quality," said Donald M. Leebern Jr., president of Georgia Crown. "The quality and purity of Poland Spring water is not being questioned, so consumers can continue to purchase Poland Spring with full confidence that they are getting a safe product."
Poland Spring is licensed to sell its product as "spring water" in 14 states and is distributed only east of the Mississippi River.
"Georgia requirements are somewhat different than the other states," said Leebern. "However, we're confident that when the Georgia Department of Agriculture reviews the additional information it requested, Poland Spring will clearly show that it meets the new standard and can properly be labeled 'spring water.'"
Poland Spring and Georgia Crown are actively working to provide all the technical data requested by the state, according to Leebern.
"The detailed, scientific information requested usually takes as much as one year to gather," he added. "However, we are expediting the process and hope to have the necessary data available in half that time. This restraining order will prevent our product from being penalized unfairly while this issue is being resolved."
