GENERATION 5 SECURES SOFTWARE RIGHTS; EXPANDS WORLD-WIDE
DENVER, June 25 /PRNewswire/ -- Generation 5 Technology Inc. (G5) (NASDAQ: GFIV) a leader in the development of Geographic Information Systems (GIS), announced today that it has entered into an agreement resolving its disputes with Generation 5 Technology Ltd., formerly known as Software Support Ltd. (SSL), of Edmonton, Alberta, Canada. Under an earlier agreement, both companies had been engaged in the international marketing of the Geo/SQL(R) Geographic Information System (GIS) software. Earlier this year SSL initiated litigation against G5 in the U.S. District Court for the District of Colorado, asserting royalty claims and ownership rights. G5 filed its own counterclaims asserting it was the author and owner of the software in question.
The settlement makes it clear that G5 is the author and owner of its Geo/SQL 3.x family of software products and has the right to continue developing and marketing those products. In addition to securing ownership rights to the Geo/SQL 3.x product line, G5 has secured exclusive rights to its name, logo and product trademarks. Under the terms of the settlement agreement SSL waived any claim of right in the G5 trademarks and the Geo/SQL 3.x software. In addition, to satisfy offsetting financial obligations under the earlier agreement, G5 will transfer to SSL a sum of $509,475.78 Canadian.
Another key to the settlement agreement is the removal of all territorial restrictions, allowing G5 to market its Geo/SQL product world-wide. According to Charles Powell, G5's chief executive officer, "We are pleased that this agreement will allow us to move forward, eliminate market confusion, and enable Generation 5 Technology Inc. to satisfy the world-wide demand for its product."
