GENCORP ANNOUNCES IT WILL APPEAL VERDICT IN
 INSURANCE TRIAL
FAIRLAWN, Ohio, Jan. 14 /PRNewswire/ -- GenCorp (NYSE: GY) announced today that Aerojet will appeal the verdict handed down yesterday in Phase II of an ongoing trial concerning its claim against insurers for the recovery of site remediation costs at Aerojet's Sacramento facility. Aerojet is the aerospace/defense sgement of GenCorp which operates the Sacramento plant.
The jury's decision according to GenCorp is unfortunate and Aerojet intends to appeal the decision immediately. "We believe the jury's verdict reflects a number of errors by the court in ruling on evidence and in jury instructions," said Charles R. Ennis, Vice President and General Counsel of GenCorp. "We are confident we can secure a reversal when this decision is appealed. When this same court ruled against Aerojet earlier in this case, Aerojet appealed the decision and the court's ruling was reversed.
"We do not know the source of the $135 million estimated liability published by other parties but we do know that neither the cost of groundwater clean up in Sacramento nor yesterday's decision by the jury represent a new or additional liability for Aerojet. This recent event is one step in a very long process related to our environmental remediation activities."
Aerojet has already spent in excess of $90 million during the last ten years in connection with chemicals discovered in the groundwater at its Sacramento facility. Aerojet has already recovered approximately $8 million from one insurance carrier and approximately $35 million under its government contracts.
GenCorp is a technology-based company with strong positions in aerospace, automotive and related polymer products.
