Former student admits to lesser charge in N.Y. dorm assault.

HERKIMER, N.Y. -- A former Herkimer County Community College student accused of sexually assaulting a 17-year-old girl in campus housing admitted to a lesser charge last month.

Rudy Volcy, 18, of New York City, was one of four other former students originally charged with felony third-degree rape. Volcy pleaded guilty to a misdemeanor charge of sexual misconduct that carries a sentence of up to a year in jail.

Herkimer County District Attorney John Crandall said Volcy has already spent some time in jail. Volcy's sentencing was scheduled for Aug. 26.

Volcy, who was 17 at the time. was accused of raping the first-year student in her apartment at a campus housing complex in September after a party where drinking was involved.

Also charged with rape were Willie Anderson, Peter Rivera and Hayward Washington, all of New York City. Leonard Mitchell, also of New York City, was indicted on misdemeanor third-degree sexual abuse.
