Former councilor, state legislator arraigned in assault; Levy charged with attacking girlfriend.

MARLBORO - Steven L. Levy, a former city councilor and state legislator, was arraigned in Framingham District Court this week after he was charged with assaulting his girlfriend outside a bar early Saturday morning.

Mr. Levy, 48, of 61 O'Grady Road, an accountant and married father of two daughters, was ordered Monday to stay away from the 43-year-old Framingham woman. His case was continued to June 17.

According to police, the woman went to the police station about 2 a.m. Saturday and reported that she had been assaulted by her "lover/boyfriend" in the parking lot of the Chicken Bone Saloon on Waverly Street.

The woman told police that she, a group of her friends and Mr. Levy were at the saloon. When she saw a friend of hers and Mr. Levy walking out near closing time, she went out to see what was happening. The woman allegedly told police that she saw the two kissing intimately. She then went back inside and had a male friend come out. The woman said she walked up to Mr. Levy and demanded that he return her cellphone and bankcard.

She said Mr. Levy became enraged when she ripped his shirt pocket as she tried to retrieve her cellphone.

Mr. Levy allegedly "grabbed her by her shirt and began to shake her violently." He also allegedly scratched her right breast and ripped her shirt.

The alleged victim told police that Mr. Levy continued shaking her violently, causing her to fall onto the pavement. The male friend helped her up and Mr. Levy again grabbed her by the shirt and shook her, she said. As the male friend tried to intercede, Mr. Levy allegedly let go of the woman's shirt, knocking her to the ground again.

The woman told police that she and Mr. Levy had been dating since January. She said they had gone out to dinner several times and that he had bought her several gifts.

Mr. Levy's wife said Tuesday Mr. Levy was not taking phone calls.

His lawyer, Daniel Cappetta of Natick, declined comment.

Mr. Levy, a Republican, was elected as a Marlboro city councilor-at-large in 2003, and served three two-year terms. He served one term as the 4th Middlesex District representative and was defeated in his re-election bid in November by former Rep. Danielle W. Gregoire, D-Marlboro, who held the seat before he did.
