Family free of blame in baby's death - coroner.

The accidental death of an 11-month-old Tipton baby boy who fell from a first-floor window was "every parent's worst nightmare", a coroner said at an inquest.

Black Country coroner Robin Balmain said Cy Withers' family was blameless for the tragic plunge at home in West Road, on Mother's Day. The baby sustained traumatic brain injuries in the incident and died two days later in Birmingham Children's Hospital.

Cy's mother Jane sobbed as she heard child abuse investigation officer Acting Det Sgt Andrew Holder exonerate her and Cy's father Timothy of any blame.

DS Holder said two police officers went to the family's house and found the baby sitting in a chair next to his mother, with a large swelling on the right side of his head above his ear. Cy was taken to Sandwell General Hospital for treatment before being transferred to the Children's Hospital. A forensic senior investigator said a safety catch on the window had been left off.

Jane's 13-year-old son Lewis had permission from his father to take Cy upstairs, and had carefully placed the baby on a bed. As he had his back turned, Cy had crawled on to a window sill and plunged on to flagstones in the back garden. There had never been any concerns about the family by health and social services bodies, he added, and ruled out further enquiries. Fighting back tears, Mrs Withers said Cy had not yet learned to walk but was advanced for his age. "He was very strong actually." Mr Balmain, recording an accidental death, said: "The circumstances of Cy's death are every parent's worst nightmare.

This was a little boy that I am satisfied was perfectly well looked after." He described the Withers family as "responsible and loving".
