FSC moved against section 497 of CrPc.

ISLAMABAD -- Federal Sharia Court (FSC) has admitted for hearing a petition seeking orders to declare section 497 of Criminal Panel Code (CRPC) repugnant to Islam..

A 3-member bench of FSC took up the petition filed by Dr Aslam Khaki for hearing Monday.

Aslam Khaki advocate took the plea that the husband has been allowed to force his wife to provide company to others for the purpose of adultery as no imprisonment term is in place to punish the husband if he forces his wife to commit adultery or indulge in perversion. Indulging in such acts is not only contravention of the law and constitution but also it runs alien to the teachings of the Quran and Sunnah.

He further took the ground that the Holy Quran enjoins in categorical and clear term that one should not come near adultery. Rigorous sentence has been prescribed for adulterer man and woman.

He prayed the court to declare this section of CrPc as repugnant to Quran and Sunnah and abolish it from PPC.

The court while issuing notice to ministry of law and justice has adjourned the hearing for indefinite period.
