FLUKE SEES END TO PATENT INFRINGEMENT SUIT WITH TALON INSTRUMENTS
 EVERETT, Wash., July 28 /PRNewswire/ -- On May 26, 1992, the jury in Fluke's patent infringement suit against Talon Instruments, located in San Dimas, Calif., returned a verdict in favor of Talon, following six weeks of trial, John Fluke Mfg. Co. Inc. (AMEX: FKM) said today. Fluke contends that the jury's verdict, which held Fluke's patent both invalid and not infringed by any of Talon's products, was "internally inconsistent and legally flawed," said Doug McKnight vice president, General Counsel. Fluke intends to file post-trial motions to overturn the verdict in the coming months.
 "Fluke invests heavily in research and development and we will continue to be vigilant in our efforts to protect our intellectual property rights," said McKnight.
 Fluke filed its suit against Talon Instruments in May 1988 in U.S. District Court in Los Angeles, for infringement of U.S. patent No. 4,455,654, which covered certain technology relating to testing microprocessor-based circuit boards. Subsequently, Talon filed counterclaims against Fluke for "inequitable conduct" in dealing with the U.S. Patent and Trademark Office in obtaining its patent and for "unfair competition" in telling others about the lawsuit.
 The "inequitable conduct" charge led to Fluke having the patent re-examined by the U.S. Patent and Trademark Office which confirmed the patentability of virtually all of Fluke's patent. A bench trial on this counterclaim was decided in Fluke's favor in January 1991. The "unfair competition" counterclaim was thrown out by summary judgment in June 1990.
