 FLIGHT ATTENDENTS' CLASS SUIT AGAINST CIGARETTE COMPANIES DISMISSED
 WAYNE, Pa., May 21 /PRNewswire/ -- A suit seeking to represent more than 65,000 claimants is too diverse to be handled as a class action, a Florida judge in Miami ruled May 19, dismissing class action allegations in a secondhand tobacco smoke suit by flight attendants who had sought $5 billion in damages from tobacco companies.
 "The case was the first secondhand tobacco suit filed against the manufacturers directly and its early dismissal will come as a disappointment to anti-tobacco activists. The tobacco companies, which have never paid damages in tobacco injury cases, continue their winning streak with this decision," according to Karen Storey, editor of "Mealey's Litigation Report: Tobacco," of Wayne, which covers all aspects of tobacco litigation.
 The complaint alleges that the cigarette manufacturers failed to inform nonsmokers of the dangers of passive smoke, claiming strict liability, breach of warranties, fraud, misrepresentation and conspiracy. The injuries alleged range from lung cancer to respiratory problems.
