FIRST CIRCUIT COURT OF APPEALS RULES IN FAVOR OF AIR & WATER TECHNOLOGIES IN PRASA LITIGATION

 BRANCHBURG, N.J., May 6 /PRNewswire/ -- Air & Water Technologies Corporation (Amex: AWT), a leading environmental treatment and services company, has learned today that the United States Court of Appeals for the First Circuit has affirmed the ruling of the Federal District Count in San Juan, Puerto Rico that the Puerto Rico Aqueduct and Sewer Authority (PRASA) is not entitled to Eleventh Amendment immunity. Accordingly, the case will now be returned to the Federal District Courtin San Juan, where the company's attorneys will request the Court to set an early trial date.
 The case was originally brought by Metcalf & Eddy, Inc. in September 1990 against PRASA to recover $52 million, of which $37.4 million was for goods and services Metcalf & Eddy sold and rendered to PRASA. PRASA challenged the jurisdiction of the Federal Court, which denied PRASA's jurisdictional challenges.
 The company believes the affirmance by the First Circuit of the ruling of the Federal District Court in San Juan will hasten a trial on the merits. According to Eckardt C. Beck, chairman and chief executive officer of AWT, "We are pleased with the First Circuit's ruling and continue to believe that we will prevail on the merits of the case. We look forward to a trial date in the near future and final resolution of this litigation."
