Experts suggest to introduce state duty for court reference to avoid frivolous claims.

A draft of the new Civil Procedure Code of Kyrgyzstan proposes to introduce state duty for the reference for court when filing a claim in order to avoid frivolous claims and complaints, Vice Chairman of the Supreme Court Gulbara Kaliyeva said on October 7 during the regular session on judicial reform.

The necessity to reform the civil procedure legislation of the country was caused by a sharp increase in the number of civil cases, and the complexity of civil disputes resolved by the courts.

The main goals of the draft Civil Procedure Code include creation of conditions for timely, high-quality and full consideration of civil cases by the courts; realization of the rights of all members of the civil process; timely protection and restoration of violated rights and freedoms of the individual, as well as of interests of the society and the state.

In addition, the experts vow to improve efficiency and transparency of the civil procedure; achieve legal stability and clarity of the civil process; develop competition in the civil process.
