Executive Committee of IHCBA suspends its President.

ISLAMABAD -- The Executive Committee of Islamabad High Court Bar Association (IHCBA) suspended presidentship of Arif Chuadhry in violation with its Constitution.

The suspension notification was issued on Friday following the Executive Committee Meeting of IHCBA held here at IHCBA office.

According to the notification, Mr. Arif Chaudhry was no more the President of the IHCBA during the period of suspension and shall not exercise the functions and powers as the President of the Association, with immediate effect till further orders.

During the suspension of Mr. Arif Chaudhry, the Vice President shall perform the functions and exercise the powers of the President as contained in Article 11 of the Constitution of the Islamabad High Court Bar Association, Islamabad.

A Special Committee of the Executive Committee of the IHCBA shall inquire into acts or omissions, etc., committed by suspended President which shall submit its Inquiry report to the Executive Committee for its decision as per the Constitution.

According to the details stated in the notification Mr. Arif Chaudhry, President of the Islamabad High Court Bar Association allegedly called an illegal meeting of the General House of IHCBA on 17-10-2017 without information and approval of the Executive Committee of IHCBA as well as without fulfilling constitutional requirements.

He in that so called meeting of the General House which was even lacking quorum as prescribed by the Constitution, passed a alleged fraudulent Resolution depriving the Secretary of the IHCBA from his constitutional powers of sanction and co-sign the cheques virtually making the Secretary disfunctional.

Such illegal acts were not only the criminal breach of trust but also fraud, misconduct and violation of the Constitution warranting even cancellation of basic membership of such a member, whether a member or an office-holder of the IHCBA, notification maintained.

It was also alleged that being President he also stopped sanction and payment of amounts from the accounts of the Association to meet day to day expenses including salaries of the IHCBA employee practically making the Association disfunctional and causing frustration among the employees of the Association.

He allegedly illegally approached the Bank and pressurized the Bank officials for encashment of cheques signed by him alongwith Joint Secretary in the light of fake Resolution dated 17-10-2017 although the IHCBA did not authorise the Joint Secretary to co-sign any cheque or financial instrument except the Finance Secretary or as authorised by the Executive Committee.

By his illegal and unconstitutional acts and omissions, etc., created rift and clashing situation among the members of the IHCBA as well as between IHCBA and Islamabad Bar Council which resulted in lowering their dignity and prestige the notification added.

After having knowledge that a meeting of the Executive Committee was convened to discuss all his illegal acts and omissions, etc., issued a Notice on 20-10-2017 that there was no meeting of the Executive Committee which was also illegal, transgression of the powers constituting misconduct on your part.

Mr Arif also cheated the Executive Committee of the IHCBA as he pretended that he would procure a huge amount as a donation from different sources for construction of Lawyer's Club if initially the Executive Committee allow him for initial spending for gray infrastructure of the proposed building. However, thereafter no such funding was ever arranged or seems to be coming whereas a huge amount of about Rs. 45,00,000/- had already been spent which was meant for other purposes including welfare of the members of IHCBA.

Therefore in pursuance of paragraph 6 of Article 21 read with Articles 13, 15 and 18 as well as all other enabling provisions of the Constitution of the Islamabad High Court Bar Association, Islamabad, with 2/3 majority of the Executive Committee of the IHCBA, the basic membership of Mr. Arif Chaudhry as the member of the IHCBA was hereby suspended.
