EXIDE ELECTRONICS WINS REVERSAL OF HENDRY JUDGMENT

EXIDE ELECTRONICS WINS REVERSAL OF HENDRY JUDGMENT
 RALEIGH, N.C., Sept. 10 /PRNewswire/ -- Exide Electronics Group,

Inc. (NASDAQ: XUPS) announced today that the United States Court of Appeals for the Ninth Circuit has reversed a $14.9 million judgment entered against Exide Electronics in 1990.
James Hendry, a former Exide Electronics sales representative, had alleged that the Company terminated him in "bad faith" in order to avoid paying commissions. Judgment had been entered against the Company following a 1990 jury trial in San Francisco.
On appeal, the Ninth Circuit held that the trial judge had improperly instructed the jury regarding controlling North Carolina law. Accordingly, the appeals court reversed the judgment against the Company, which with interest stood at over $18 million when the decision was rendered. The Company expects to be relieved from its $12.5 million appeal bond in accordance with customary appellate court procedures.
James Risher, President and Chief Executive Officer of Exide Electronics, stated: "We are extremely pleased with the Court's action in reversing the trial court judgment, which we felt was wrong and unfair. We had vigorously defended the Company at the trial level. Our legal team performed admirably on the appeal and we feel that, in the end, justice was properly served."
"We can now focus on achieving our business objectives and will enter fiscal 1993 with optimism and significant momentum. We are very appreciative of the support we have received from our shareholders, customers, suppliers and employees during a challenging period in our corporate history. We are proud of our relationships with these groups and are glad they share our excitement about the future."
