EXIDE ELECTRONICS GROUP, INC. ANNOUNCES ORDER BY COURT OF APPEALS IN HENDRY LITIGATION

 RALEIGH, N.C., June 2 /PRNewswire/ -- Exide Electronics Group, Inc. (NASDAQ: XUPS), announced today that the United States Court of Appeals for the Ninth Circuit has issued an order in the case entitled James Hendry d.b.a. Synergy Sales Engineering v. Exide Electronics Corporation ("Hendry"). The case, filed by a former company sales representative, sought commissions allegedly arising out of a United States government contract that the company won after Hendry was terminated, and other sales agreements. In April 1990, a jury in the United States District Court for the Northern District of California found for Hendry, but last September the Court of Appeals reversed the judgment against the company. In January 1993, the appellate court sent the case back to the District Court for "further proceedings consistent with" its opinion.
 In March 1993, the District Court conducted a hearing to determine what "further proceedings" should be permitted, including whether or not to grant a new trial. The District Court did not rule, but rather asked the parties, "by appropriate motion," to seek clarification from the Ninth Circuit as to whether its reversal of the judgment for Hendry "called for or permitted a new trial... ." On April 30, 1993, Hendry filed with the Court of Appeals a motion seeking to have that court direct the District Court to proceed to trial on all of his claims.
 The latest order by the Court of Appeals upholds the reversal of the 1990 trial judgment in favor of Hendry and declines to specify which, if any, claims are to be retried. Instead, it sends the case back to the District Court, "which shall order retrial of such of the claims for relief other than that covered by our decision, which the District Court determines are still viable." Nicholas J. Costanza, vice president and chief legal counsel of the company, stated: "We will argue to the District Court that Mr. Hendry was properly terminated and that no viable claims remain in his case against Exide Electronics in light of the Ninth Circuit's prior opinion on the merits of this case. In any event, we are pleased that the Ninth Circuit adopted Exide Electronics' position that the District Court must decide, in the first instance, the appropriate application of the appellate court's opinion on Mr. Hendry's claims." The company does not know how or when the District Court will decide these matters.
