EXIDE ELECTRONICS GROUP, INC. REVISED ORDER ISSUED IN HENDRY LITIGATION

RALEIGH, N.C., Feb. 2 /PRNewswire/ -- Exide Electronics Group, Inc. (NASDAQ: XUPS), announced today that on Jan. 29, 1993 the United States Court of Appeals for the Ninth Circuit granted a motion by the plaintiff in "Hendry v. Exide Electronics Corporation" that the Ninth Circuit clarify or amend a prior mandate issued by it in the litigation. The "Hendry" case involves claims by the plaintiff that the Company failed to pay commissions allegedly due in connection with various sales involving the federal government and others. The plaintiff had obtained a jury verdict against the Company in the U.S. District Court for the Northern District of California in which damages of approximately $14.9 million were awarded to the plaintiff. In September 1992, the Ninth Circuit issued a mandate reversing the judgment, and subsequently denied the plaintiff's motion for rehearing by the appellate panel and reconsideration by the entire court. The U.S. District Court then denied the plaintiff's motions for a new trial on remaining issues, if any, indicating that the Ninth Circuit had reversed the prior judgment and had not remanded the case to the District Court. In granting the plaintiff's most recent motion, the Ninth Circuit's revised mandate still reverses the lower court's judgment, but now states that the case is being sent back to the District Court "for further proceedings consistent with" the appellate court's opinion.
Nicholas J. Costanza, Vice President and Chief Legal Counsel of Exide Electronics Group, Inc., stated, "While the appeal by the Company of the original $14.9 million judgment is over and this latest development does not change the appellate court's reversal and vacating of the $14.9 million jury verdict, the Company does not know at this time what further proceedings may evolve from this litigation. Until those proceedings are determined by the District Court, we can provide no assurance as to the ultimate outcome of the litigation."
