EXIDE ELECTRONICS GROUP, INC. ANNOUNCES POSTPONEMENT OF HENDRY TRIAL

RALEIGH, N.C., Nov. 1 /PRNewswire/ -- Exide Electronics Group, Inc. (NASDAQ: XUPS) announced that it was notified today by the United States District Court for the Northern District of California that the trial date in the Hendry matter has been changed. The new trial is now scheduled to begin on Jan. 4, 1994.
Exide Electronics had been scheduled to begin trial in the case of "James Hendry d.b.a. Synergy Sales Engineering v. Exide Electronics Corporation" ("Hendry"), on Tuesday, Nov. 2, 1993.
That suit asserted various substantial claims based on an alleged failure to pay commissions to Mr. Hendry in connection with sales arising out of a contract with the Air Force. A verdict in favor of Mr. Hendry for some $14.9 million following a trial in 1990 in the District Court was reversed by the Ninth Circuit Court of Appeals in 1992. In July 1993, the trial court determined that a number of the plaintiff's claims may not be tried, but ordered a new trial to be held on the plaintiff's claims of breach of oral contract, fraud and "quantum meruit" (i.e., reasonable compensation for services rendered).
The company cannot predict the outcome of the new trial, and there can be no assurance as to the ultimate outcome of this matter.
