EXEL'S FLASH PATENTS

 SAN JOSE, Calif., July 2 /PRNewswire/ -- EXEL Microelectronics (EXEL), a division of ROHM Corp., released the following information regarding its FLASH patents.
 Two United States patents were awarded to EXEL, No. 4,698,787 on Oct. 6, 1987, and No. 4,868,619 on Sept. 19, 1989, which cover the following critical elements:
 -- Transistor Insulating Materials
 -- Transistor Structure
 -- Entire Cell Array Erase Mode
 -- Array Architecture
 These patents are important because they cover the basic technology utilized by FLASH memory chips. FLASH memory chips utilize a single transistor cell architecture, which provides a lower-cost solution than traditional EEPROMs (Electrically Erasable Programmable Read Only Memory). Unlike dynamic random access memory chips, FLASH chips retain their data even when power is removed from the chip. Ed Chow, vice president and general manager of EXEL stated, "I believe our two patents cover the fundamental FLASH implementation and design concepts. EXEL is devoting additional resources to its FLASH development efforts and plans to be in production next year."
 EXEL has been conducting research and development in nonvolatile memory technology since the company's inception. One of the results of this research was the invention of the single transistor FLASH memory device and methods for manufacturing this device. The patent application for No. 4,698,787 was filed in November 1984, and No. 4,868,619 was filed in August 1986. Subsequently, patent applications were filed in Japan and Europe.
 No. 4,698,787 was subject to an interference action (Case No. 102,258) with Intel's Application Serial No. 07/253,775, which claims the benefit of Application Serial No. 06/667,905. On Aug. 12, 1992, the Patent and Trademark Office awarded Intel priority to certain claims. On June 21, 1993, the Court of Appeals for the Federal Circuit Court (Case No. 93-1068) vacated the decision of the Patent and Trademark Office Board of Patent Appeals and Interference, and remanded this matter back to the Patent and Trademark Office.
 While Intel's initial application was filed several weeks prior to EXEL's application, it is EXEL's position that Intel's patent application fails to meet established patent filing requirements. Furthermore, EXEL believes that Intel's claimed patent interests on FLASH technology are without legal merit for various reasons.
 In light of the recent decision by the Federal Circuit Court and in response to recent press releases concerning the FLASH patents, EXEL wants to make it clear that it has not asserted any patent infringements claim against Intel nor any other FLASH chip manufacturer.
 EXEL designs, manufactures and markets EEPROMs and ASEC(TM) (Application Specific Embedded Controllers) worldwide from its headquarters in San Jose. Founded in 1983, EXEL was acquired in 1988 by ROHM Corp., a wholly owned subsidiary of ROHM U.S.A., which is a wholly owned subsidiary of Kyoto, Japan-based ROHM Co., Ltd.
