EPA SETTLES WITH MRS. SMITH'S FROZEN FOODS COMPANY, ROSSVILLE, TENN., FOR VIOLATIONS OF CERCLA AND EPCRA

 ATLANTA, Nov. 2 /PRNewswire/ -- The U.S. Environmental Protection Agency announced today the settlement of an administrative enforcement action against Mrs. Smith's Frozen Foods Company, Rossville, Tenn., a subsidiary of Kellogg Company (NYSE: K), for alleged violations of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA, also known as Superfund) and the Emergency Planning and Community Right-To-Know Act (EPCRA).
 According to the complaint, the company allegedly failed to submit timely reports to the National Response Center, the State Emergency Response Commission (SERC) and the Local Emergency Planning Committee (LEPC) following an accidental release of 2,600 pounds of ammonia from its facility. The reportable quantity for ammonia is 100 pounds. The release, believed to have been caused by a faulty safety relief valve, occurred over a two-day period while the facility was expanding its refrigeration system.
 The Consent Agreement and Consent Order requires the company to pay a $20,000 civil penalty to the United States Treasury for the EPCRA violation and a $20,000 civil penalty to the EPA Hazardous Substance Superfund for the CERCLA violation.
 CERCLA and EPCRA regulations, in part, require facilities to immediately notify the National Response Center, the State Emergency Response Commission, and the Local Emergency Planning Committee when there has been a spill or release of a hazardous substance in an amount equal to or greater than the reportable quantity. Immediate notification enables federal, state and local officials to determine whether they need to render emergency assistance. Failure to do so precludes these officials from being able to make a timely response if needed. The law also requires follow-up reporting. As soon as practicable after the releaset?he company must submit a written report to both the LEPC and the SERC.
