ENVIRONMENTAL CONSULTANT INDICTED FOR FALSE STATEMENTS

ENVIRONMENTAL CONSULTANT INDICTED FOR FALSE STATEMENTS
BOSTON, Jan. 29 /PRNewswire/ -- Today a federal grand jury indicted

Kenneth R. Nugent, 10 Kernwood Dr., Lynn, Mass., an environmental consultant for the Evergreen Construction Company, for submitting a false hazardous waste permit application to the United States Environmental Protection Agency.
United States Attorney for the District of Massachusetts Wayne A. Budd announced that Nugent allegedly submitted a falsely backdated permit application to the Environmental Protection Agency in an attempt to mislead the agency into believing that his company, Evergreen Construction Company, 34 Williams Way, Bellingham, Mass., had submitted a valid and timely permit application under the Resource and Recovery Conservation Act, the federal hazardous waste statute. The indictment alleges that Nugent falsely backdated the permit application and lied to the environmental protection agency concerning the date of the original submission of the application in an attempt to convince the agency that the Evergreen Construction Company qualified for a hazardous waste permit.
Budd stated: "This office will continue to be in the forefront of environmental criminal prosecutions including cases involving false permit applications because such applications are at the heart of the nation's environmental preservation efforts."
Environmental Protection Agency Regional Administrator Julie Belaga said, "The regulated community should be forewarned that submission of false information rarely remains a secret for long and could result in criminal charges. Truthful and accurate reporting of information to EPA is vital to our mission of environmental progress."
The case was investigated by agents of the Office of Criminal Investigations, U.S. Environmental Protection Agency, and will be prosecuted by Assistant United States Attorney Richard E. Welch, III and Special Assistant United States Attorney Andrew E. Lauterback of the Economic Crimes Division within the United States Attorney's Office.
