EMULEX AGREES TO DIGITAL'S SDI/STI PHASE-OUT PROGRAM

 EMULEX AGREES TO DIGITAL'S SDI/STI PHASE-OUT PROGRAM
MAYNARD, Mass., Dec. 9 /PRNewswire/ -- Digital Equipment

Corporation (NYSE: DEC) and Emulex Corporation (NASDAQ: EMLX) of Costa Mesa, Calif., announced today in a joint statement that Emulex has agreed to Digital's SDI/STI Phase-Out Program. As a result, the patent infringement action filed by Digital in Los Angeles is being dismissed.
The industry-wide phase-out program, announced by Digital last June, permits those companies marketing and selling storage products using Digital's SDI/STI interconnect technology to continue selling such products until Dec. 31, 1992, and allows them time to make the transition to other storage interconnect technologies. To date, over 20 companies, including Emulex, have now joined that program. Digital's enrollment period for this program is scheduled to close Dec. 31, 1991.
Digital and Emulex had previously held discussions on the phase-out in July and August in an attempt to avoid litigation. When those discussions stalled, Digital filed its patent infringement suit against Emulex in Los Angeles on Aug. 13, 1991. Emulex responded by denying Digital's claims and by asserting a number of counterclaims against Digital. The agreement announced today covers the California action and its counterclaims.
Emulex Agrees to SDI/STI Phase-Out Program
"We applaud Emulex's decision to participate in Digital's SDI/STI Phase-Out Program and close the books on this dispute for both our companies", said Charles F. Christ, Digital's vice president for Mass Storage Systems. Robert Stephens, Emulex's president and CEO, echoed Christ's comment. "This is the right business decision for Emulex. Our decision to agree to the phase-out and withdraw our challenge of Digital's patents relating to its SDI/STI technology will normalize our relationship with Digital and lead to a new relationship that may benefit both of us in the future."
