ELEVENTH CIRCUIT RULING ON DONNELLEY CASE

 OMAHA, Neb., Sept. 7 /PRNewswire/ -- In a major victory for independent database publishers, such as American Business Information, Inc. (NASDAQ: ABII), and a major setback for telephone companies and classified directory publishers, the United States Court of Appeals for the 11th Circuit ruled that taking or copying name, address, telephone number, heading and size of advertisement for each listing in a classified yellow pages directory did not constitute copyright infringement. The decision, announced on Sept. 2, 1993, in "BellSouth Advertising & Publishing Corp. vs. Donnelley Information Publishing, Inc.," reversed the order of the trial court which had been affirmed by a panel of the appellate court. The court adopted the legal position asserted by ABI since 1984 in various lawsuits brought against it by Bell classified directory publishers. Donnelley had published a competing classified business directory and had used listing information copied from the BAPCO directory for its lead sheets and directory. This decision is consistent with copyright law concerning compilations as announced by the U.S. Supreme Court in "Feist Publications vs. Rural Telephone Service," __ U.S. __, 11 S. Ct. 1282 (1991) and as followed by case law in other federal circuits.
 This opinion by the full Court of Appeals fully supports ABI's position in the 1990 copyright infringement lawsuit instituted by BellSouth Advertising against ABI which matter is governed by the law of the 11th Circuit. ABI expects that the pending lawsuit will soon be resolved in ABI's favor on the basis of this decision.
