ELAN/AMERICAN CYANAMID WITHDRAW MOTION
FOR INJUNCTIVE RELIEF AGAINST CIBA-GEIGY
NEWARK, N.J., Dec. 19 /PRNewswire/ -- Elan Corporation, plc (AMEX: ELN) and American Cyanamid Company (NYSE: ACY) said today they withdrew their motion for a preliminary injunction to halt the marketing of a nicotine transdermal patch by Ciba-Geigy Corporation. A hearing on this matter has been scheduled for tomorrow, Dec. 20, in U.S. District Court in Newark.
Elan and American Cyanamid said the motion was withdrawn because the urgency for relief on the basis of irreparable damages no longer had an adequate legal foundation due to a decision last Friday by a U.S. District court judge in Northern California to lift a temporary restraining order against the marketing of a nicotine patch by Marion Merrell Dow, Inc.
Elan and American Cyanamid are continuing their patent infringement actions against Ciba-Geigy, Marion Merrell Dow, Inc. and Alza Corporation and said they will pursue aggressive protection of their rights.
