EASTERN ASSOCIATED, THREE AFFILIATES FILE FEDERAL RICO LAWSUIT AGAINST UMWA INTERNATIONAL FOR VIOLENCE AND INTIMIDATION

 CHARLESTON, W.Va., July 21 /PRNewswire/ -- Citing a 10-year-long pattern of violence and intimidation in the coal fields by the United Mine Workers of America (UMWA) International, Eastern Associated Coal Corp. and three affiliated companies today filed a civil Racketeer Influenced and Corrupt Organizations Act (RICO) lawsuit against the union.
 Eastern Associated was joined in its action by Peabody Coal Company, Colony Bay Coal Company and Martinka Coal Company. The companies are asking that the court issue an injunction against continued acts of violence by the UMWA International. The lawsuit was filed in U.S. District Court in Clarksburg, W.Va.
 In managing and conducting the affairs of the UMWA, the International has regularly and routinely "engaged in acts of violence and intimidation ranging from damage to the physical facilities of employers to violent attacks upon employees," the companies said in their complaint.
 The companies cited a partial list of more than 50 acts of violence, including attempted murder, arson, extortion, kidnapping, unlawful impeding of interstate commerce and obstruction of justice.
 In their complaint, the companies point out that since 1985 the UMWA International has been subject to more than 35 separate complaints by the National Labor Relations Board and federal and state court orders. Nevertheless, the companies say, the International "continues its campaign of anarchy and destruction."
