Dubin wins Supreme Court case in Kentucky.
AMAA Board Member Ron Dubin, MD, reports that he has been working on yet another project for the past six years. He explains that the Kentucky Physical Therapy Licensing Board has been restricting physicians in the state of Kentucky from doing physical therapy in their offices. "They initially challenged me in 2003 and since then it has gone from the Franklin County Circuit court [which we won] to the Court of Appeals [which we lost] and then to the Kentucky Supreme Court," says Dubin. "We won last month [April] with a unanimous and favorable opinion."
With the support of the Kentucky Medical Association (KMA) and American Medical Association (AMA), Dubin spent over $150,000 in legal fees and hundreds of hours assisting his attorney. "The KMA has shared in half of the legal fees and both associations filed Amicus Brief on my behalf," explains Dubin.
According to Dubin, the KMA and AMA chose to get involved because of the precedent-setting nature of the case for the scope of practice issues in Kentucky and the nation. "It would not surprise me if this case was appealed to the U.S. Supreme Court due to the importance of these issues in today's healthcare climate," says Dubin.
