Double murder case: Supreme Court constitutes special bench.

ISLAMABAD -- Supreme Court has ordered to constitute special bench on the petition filed against the decision of High Court, in which accused Zeeshan was handed down a death sentence in Toba Tek Singh dual murder case.

Zeeshan was implicated, along with his two accomplices, in the murder of his cousin Mahpara and her mother Shahnaz.

Trial court and High court has sentenced accused Zeeshan to be hanged. However an appeal against the sentence was filed in the Supreme Court.

Three member bench headed by Chief Justice Iftikhar Mohammad Ch heard the case on Thursday.

During the course of proceeding, the counsel of the accused argued before the court that his client has been wrongly implicated in the case on the base of suspicion and a death sentence cannot be handed down on the basis of suspicion alone.

Chief Justice Iftikhar Mohammad Chaudhry remarked during hearing that major criminals are being acquitted because of the failure of prosecutors.

Justice Jawad Khawaja remarked that English language has created problems in the proceedings of case, first blood relatives are facing difficulties from the word "cousin" in the prosecution of criminal cases, and it beyond comprehension that why such a large number of people were standing in the identification parade.

Court said it is an important case for which special bench would be formed after which the hearing was adjourned till 20th of May.
