DUPONT MAILS OUT LETTERS DETAILING BENLATE CHALLENGE

WILMINGTON, Del., June 22 /PRNewswire/ -- Letters with details of DuPont's (NYSE: DD) Benlate Challenge are being mailed this week to attorneys representing growers eligible to participate.
"If litigants choose not to participate, it will be because they're afraid of going head to head with science, not because they hadn't heard about the Challenge," said William F. Kirk, DuPont vice president, agricultural products.
DuPont Chairman and CEO Edgar S. Woolard Jr. threw down the gauntlet to plaintiffs at a news conference here last week: test Benlate DF on the plants specified in the lawsuits, at label rates, at any one of 10 top agriculture universities in the United States. DuPont will pay for the test as part of a legally binding agreement with the plaintiff.
If tests show Benlate caused damage claimed in a suit, DuPont will pay for the crop damage. Conversely, if Benlate is shown not to cause plant damage, the plaintiff must agree to withdraw the suit.
Additionally, anyone with knowledge of someone who intentionally and in bad faith withheld evidence or falsified data about Benlate can contact Howard Johnson, former chairman of MIT Corporation and an outside director of DuPont's board, who was appointed the ombudsman in this case.
Johnson can be contacted at Post Office Box 1433, Wilmington, Del., 19899. He has retained Wilmington independent counsel Charles S. Crompton Jr. with Potter, Anderson and Caroon, to administer the post office box and probe specific allegations of wrongdoing. Johnson will make a public report of what he learns.
