DUPONT ISSUES ANNOUNCEMENT

 WILMINGTON, Del., July 2 /PRNewswire/ -- The first Benlate(R) DF court case scheduled for trial in California has been dismissed, DuPont (NYSE: DD) announced today. It was the first such dismissal of a Benlate product liability action.
 The suit was dropped, on the eve of the trial, by the plaintiff, Marsden Darian.
 Darian initially sought general damages of $2.5 million plus property damage, loss of earnings and business damages. The suit alleged Benlate damaged "rare and exotic palms" in 1991, and was filed in San Diego Superior Court in February 1992.
 "We were convinced the case lacked merit from the outset," said William F. Kirk, Du Pont vice president for agricultural products. "Apparently the plaintiff agreed."
 Darian dropped his entire action "with prejudice," meaning that the case cannot be restarted. DuPont, meanwhile, agreed not to seek sanctions against Darian or to recoup its court costs.
 "We are pleased to get this first case under our belt," said Kirk. "The decision by Darian to drop this case should be noted by others who have made similar Benlate damage allegations. We have the scientific evidence to back up our belief that Benlate did not cause crop damage and we will use it in court."
