DUKE POWER CO. SETS ASIDE $30 MILLION DUE TO COURT RULING
CHARLOTTE, N.C., June 24 /PRNewswire/ -- As stated in Duke Power Co.'s (NYSE: DUK) filing made June 10, 1992, on Form 8-K with the Securities and Exchange Commission, the company is recording a $30 million reserve against second quarter earnings, about 15 cents per share, due to a North Carolina Supreme Court ruling on a 1986 rate case.
On April 22, 1992, the N.C. Supreme Court remanded for a second time the company's 1986 rate case to the N.C. Utilities Commission (NCUC). In the ruling, the court stated that the record from the 1986 proceedings failed to support the 13.2 percent rate of return on common equity.
The final amount and timing of the order from the commission are unknown.
The court ruling covers rates from 1986 until Nov. 1991, when the NCUC approved a new rate case.
