DOW CORNING REMAINS FULLY LIABLE IN BREAST IMPLANT SETTLEMENT

 ATLANTA, Dec. 3 /PRNewswire/ -- Following decisions rendered yesterday by Chief Judge Sam Pointer of the Northern District of Alabama, who is overseeing the national federal breast implant litigation, Dow Corning's parent organizations, Dow Chemical and Corning, were excused from liability only on a temporary basis, with Judge Pointer reserving the right to review the ruling at a later date on the basis of additional evidence obtained in the continuing discovery. Dow Corning continues as a defendant with full liability. And Baxter International's attempt to obtain dismissal was rejected, leaving it a defendant along with subsidiary Baxter Healthcare. In response to numerous inquiries some public confusion, Ralph Knowles and Stan Chesley, co-chairs of the Plaintiffs' Steering Committee, made clear the following:
 1. Dow Corning, is in no way excused from its liability or potential obligations for injuries from breast implants.
 2. Dow Corning has substantial assets and remains financially solvent and secure.
 Judge Pointer also stated, "By like token, should Dow and Corning provide financial support and assistance to Dow Corning in an attempt to effect a global settlement of breast implant claims against Dow Corning, such actions would not indicate any improper domination or control, but rather would be consistent with their interests as stockholders owning a valuable asset."
 In a related decision, Judge Pointer ruled that Baxter International, as the result of a 1985 merger with American Hospital Supply Corporation, is subject to jurisdiction in all 50 states and can therefore be sued for breast implant liabilities arising from Heyer Schulte breast implants.
 The court acknowledged the states may have different summary judgment standards or corporate responsibility laws that may lead to different results. The federal ruling does not preclude claims against Dow Corning from going forward in state courts.
