DON CARLOS MEXICAN RESTAURANTE TO SUE CITY OF DETROIT

 DEARBORN, Mich., March 12 /PRNewswire/ -- The following was released today by Don Carlos Mexican Restaurante:
 After unsuccessfully trying to negotiate a settlement with the city of Detroit for water damage which closed down Dearborn's popular Don Carlos Mexican Restaurante, Carlos Shaffran, president, is officially taking it to the legal system today.
 Don Carlos Dearborn, Inc. dba Don Carlos Mexican Restaurante, and the Grosse Pointe Park law firm of Frank & Klaasen are filing suit against the city of Detroit, et al., in the Wayne County Circuit Court.
 The lawsuit stems from damage incurred as a result of a 42-inch water main break of May 1992. The water main is owned, operated and maintained by the city of Detroit. Following almost a year of frustrated efforts dealing with the Detroit Water and Sewerage Department attorneys, Shaffran feels he has no other recourse.
 The destruction of his family business, which employed 60-plus individuals, has left Shaffran and his family financially and emotionally devastated. The 60 employees have filed with the Michigan Employment Security Commission and have been collecting unemployment since that time.
 Due to the damage already sustained and the losses mounting on a continuing basis, it is unlikely that the restaurant will ever re-open. Consistently rated as one of the top restaurants in the state, Shaffran is particularly proud that it was named one of the top 50 Hispanic restaurants in the country, three years in a row, by Hispanic Magazine, Washington, D.C.
 Shaffran estimates his losses are in excess of $3 million. This estimate does not include the considerable losses to the building owner, Davis Halin Inc. A building with historical significance, it was originally built in 1914 by Henry Ford to provide water to his estate. It was also used for soy bean research by Dr. George Washington Carver. It is located at 21031 Michigan Ave., Dearborn.
